Terms and Conditions

1. Owner

Ricardo López Alcántara, Tax ID (NIF) 08005562K, with address at Calle Velázquez 31, 28001 Madrid, and contact email ricardo@ruisenor.es (hereinafter, "Ruiseñor").

2. Nature of the service

Ruiseñor provides B2B information and commercial intelligence services, consisting of preparing and delivering periodic reports on business openings and upcoming openings. The service is exclusively directed at companies and professionals, not consumers.

3. Conditions applicable to each engagement

The scope, price, frequency, duration and other conditions of the service shall be those expressly agreed between Ruiseñor and each client, whether by signed contract, email exchange, or the description included in the payment link accepted by the client.

In case of discrepancy between these general terms and what was individually agreed with a client, the latter shall always prevail.

4. Nature of the information delivered

Reports are prepared from publicly accessible sources and specialized providers. Ruiseñor applies reasonable measures to ensure their quality, but does not guarantee the accuracy, completeness or permanent currency of the information, nor a specific volume of records unless expressly agreed, nor any commercial result derived from their use.

Commercial decisions the client makes based on the reports are their sole responsibility.

5. Use of information

Information delivered is for the client's use in their own commercial activity, including direct contact with companies and professionals included in the reports. Unless expressly agreed otherwise, the client may not resell the reports or transfer them, in whole or in part, to third parties outside their organization.

The client is responsible for processing personal data contained in the reports in accordance with data protection regulations, in their capacity as independent controller.

6. Payments

Payments are made in advance through the enabled payment platform. Unless otherwise agreed, prices are quoted excluding taxes, which will be added or passed on according to applicable regulations for each client.

7. Liability

Ruiseñor's liability to the client is in any case limited to the amount actually paid by the client in the three months preceding the event giving rise to it. Indirect damages and loss of profits are excluded.

8. Modifications

Ruiseñor may modify these terms. The current version will be the one published on ruisenor.es. Modifications will not affect agreements already in force with clients.

9. Applicable law

These terms are governed by Spanish law. The parties submit to the courts of Madrid capital.
